Welcome to Breezy Auto Detail LLC. By accessing our website, purchasing retail products, or booking our detailing services, you agree to the following terms and all applicable regulatory requirements. This agreement is between Breezy Auto Detail LLC (hereinafter referred to as 'Breezy Auto', 'we', 'us', 'our') and you, the customer ('you', 'your', or 'client'). By using our website, booking a service, or purchasing products, you agree to these terms.

1. Services & Professional Detailing

Vehicle Condition: Customers must disclose any pre-existing damage. We are not responsible for clear coat failure, oxidized paint, or loose trim affected by standard cleaning.
Personal Property: Please remove all valuables. We are not responsible for lost or damaged items left inside the vehicle. (NOTE: If we do happen to come across anything that may be of value that may have left behind unknowingly, an act of good faith, the company shall place these items into a designated storage container and logged for customer retrieval after service).
Mobile Service: For mobile detailing in Mililani and surrounding areas, the client must provide safe workspace with sufficient clearance.

2. Retail Product Sales:

Product Use: Breezy Auto provides professional-grade supplies. We are not liable for damage resulting from improper use. Always follow the instructions on the label.
Returns: Unopened products may be returned within 30 days.

3, Regulatory Compliance & Consumer Rights

Hawaii Consumer Protection: In accordance with Hawaii Revised Statutes (HRS), we provide services with professional care. Any warranties provided are limited to the specific service performed.
Right to Refuse: We reserve the right to refuse service if the work environment is unsafe or if the vehicle contains hazardous materials (mold, biohazards) not disclosed at booking.

4. Communications & Consent (TCPA & GDPR)

Express Consent: By providing your phone number, you provide "express written consent" under the Telephone Consumer Protection Act (TCPA) to receive recurring automated service updates and marketing via SMS or email.
Opt-Out: Consent is not a condition of purchase. You may opt-out at any time by replying STOP to any text or clicking Unsubscribe in emails.

5. Limitation of Liability & Indemnification

Liability Cap: To the maximum extent permitted by law, Breezy Auto's total liability for any claim shall not exceed the total amount paid by the customer for that specific service or product.
Indemnification: You agree to indemnify and hold Breezy Auto harmless from any claims, damages, or expenses arising from your violation of these terms or misuse of our retail products.

6. Dispute Resolution & Governing Law

Governing Law: These terms are governed by the laws of the State of Hawaii.
Arbitration: Any disputes arising from these terms shall be settled through binding arbitration in Honolulu County, Hawaii, rather than in court, except small claims matters.

7. Force Majeure

Breezy Auto shall not be liable for any failure to perform services due to "Acts of God", including but not limited to heavy rain, high winds, or other hazardous weather conditions common in Hawaii, which may make mobile detailing unsafe.
